Client Service Agreement and Informed Consent

Function Bone Health — A Project of BioX Unlimited LLC

This is a one-time agreement executed upon account creation. By signing this agreement or creating an account on functionbonehealth.com, you acknowledge that you have read, understand, and voluntarily agree to all terms below.

Parties

Provider: BioX Unlimited LLC, a Florida limited liability company, doing business as Function Bone Health and operating Strength Lab Plus wellness studios. 3341 N Tamiami Trail, Naples, FL 34103

1. Nature of Services — Client Acknowledgment

By signing this Agreement, I, the undersigned Client, acknowledge, understand, and agree to the following:

1.1 Wellness Education and Screening Center

Function Bone Health is a wellness education and screening center. It is NOT a healthcare provider, medical clinic, medical practice, hospital, diagnostic center, or any form of licensed medical facility.

1.2 Educational and Informational Services Only

All services provided by Function Bone Health — including but not limited to REMS bone health assessments, BioDy body composition analyses, wellness consultations, educational plans, courses, webinars, articles, and all other content and services — are provided solely for educational and informational purposes.

1.3 No Medical Advice, Diagnosis, or Treatment

Function Bone Health does NOT provide medical advice, medical diagnosis, medical treatment, clinical assessment, or any form of healthcare service. No service provided constitutes medical care.

1.4 No Medical Relationship

My use of Function Bone Health services does NOT create a doctor-patient, therapist-client, clinician-patient, healthcare provider-patient, or any similar professional medical or clinical relationship between me and BioX Unlimited LLC, Function Bone Health, Strength Lab Plus, or any of their owners, officers, directors, employees, agents, coaches, educators, subcontractors, or affiliated entities.

1.5 Wellness Coaches and Educators

All staff members providing services at Function Bone Health function as wellness coaches, health educators, and screening technicians. They do not act in a clinical or medical capacity. Any professional credentials held by staff members are disclosed for transparency and do not indicate that medical services are being provided.

1.6 Screening, Not Diagnosis

REMS bone health assessments and all other assessments are screening measurements, NOT medical diagnoses. Results are data points generated by screening technology and do not constitute medical opinions or clinical conclusions.

1.7 Share Results with Healthcare Provider

I understand that I should share all screening results with my licensed healthcare professional for clinical interpretation and medical decision-making. Function Bone Health encourages but cannot require me to seek medical consultation.

1.8 Screen My Bones License

Function Bone Health operates its REMS screening under a Screen My Bones license. Screen My Bones is a separate, independent entity — it is not affiliated with, owned by, or a part of BioX Unlimited LLC or Function Bone Health.

2. Services Covered

This Agreement covers all current and future services offered by Function Bone Health, including but not limited to:

REMS Bone Health Assessment (radiation-free ultrasound-based screening)
BioDy Body Composition Analysis
Wellness Education Consultations
Personalized Wellness Education Plans
Educational content, courses, webinars, and programs
Supplement store purchases
Any additional services introduced in the future

3. REMS Technology Acknowledgment

I acknowledge and understand that:

REMS technology is manufactured by Echolight S.p.A. and is FDA-cleared under 510(k) K213854
The technology uses ultrasound (zero radiation) for bone health screening
REMS provides screening measurements of bone density and quality indicators
REMS is NOT a replacement for DXA scans or other medical diagnostic imaging
Results may vary and are not guaranteed to be 100% accurate
Factors including body composition, positioning, and physiological variations may affect results
I will share screening results with my healthcare provider for clinical interpretation

4. Health Information Consent

I consent to:

The collection of health-related screening data as part of the services I receive
The use of my screening data for service delivery, wellness tracking, and educational purposes
The storage of my screening data in accordance with the Privacy Policy and HIPAA-Aligned Notice
Receiving communications related to my screening results and services

I understand that:

My data will be protected by the safeguards described in the Privacy Policy
I may request access to, correction of, or deletion of my data at any time
I may withdraw my consent by contacting support@functionbonehealth.com

5. Assumption of Risk

I acknowledge and voluntarily assume the following risks:

Screening assessments are educational tools, not medical care, and may not detect all conditions
Acting on screening information without consulting a licensed healthcare provider involves risk
Screening results may contain inaccuracies inherent to any technology
Wellness education and coaching information is general and may not be appropriate for my specific health situation
Supplements purchased through the store may interact with medications or conditions

I agree that I will NOT rely solely on Function Bone Health screening results or educational information for health-related decisions. I will consult my licensed healthcare provider for medical guidance.

6. Financial Terms

I agree to pay all fees associated with services I select, at the rates in effect at the time of booking
A security deposit is required for all service bookings, applied toward the total service cost
Full payment is due at or before the time of service
I have read and agree to the Refund Policy at functionbonehealth.com/legal/refund-policy
If using HSA/FSA funds, I am responsible for verifying eligibility with my plan administrator
I am responsible for any applicable taxes

7. Release of Liability and Waiver of Claims

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

I, the undersigned Client, voluntarily, knowingly, and freely release, waive, and forever discharge BioX Unlimited LLC, Function Bone Health, Strength Lab Plus, and all of their respective owners, officers, directors, members, managers, employees, agents, independent contractors, subcontractors, licensors, suppliers, partners, coaches, educators, successors, assigns, and affiliated entities (collectively, "Released Parties") from any and all claims, demands, actions, causes of action, suits, damages, losses, costs, expenses (including attorneys' fees), and liabilities of every kind and nature, whether known or unknown, suspected or unsuspected, arising from or related to:

a) My use of any services provided by Function Bone Health b) My reliance on screening results, educational information, or wellness guidance provided c) Any actions I take or do not take based on information provided by Function Bone Health d) Any inaccuracies, errors, or limitations in screening results or educational content e) Any interaction with staff, coaches, educators, or consultants f) My use of the Website, mobile application, or any digital platform g) My purchase or use of supplements from the Function Bone Health store h) Any injury, illness, condition, or health outcome that I attribute, rightly or wrongly, to my use of Function Bone Health services i) Any loss of data, privacy breach, or technology failure j) Any third-party claims arising from my use of Function Bone Health services

This release includes claims arising from negligence (but not gross negligence or willful misconduct) of the Released Parties.

8. Indemnification

I agree to indemnify, defend, and hold harmless all Released Parties from and against any and all claims, demands, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys' fees and court costs) arising from or related to:

My use of Function Bone Health services
My breach of this Agreement or any Legal Document
My violation of any applicable law, regulation, or third-party right
My negligence or willful misconduct
Any dispute between me and any third party related to Function Bone Health services

9. Dispute Resolution

9.1 Mandatory Binding Arbitration

Any dispute arising out of or relating to this Agreement or my use of Function Bone Health services shall be resolved exclusively through final and binding arbitration administered by the American Arbitration Association (AAA) in Naples, Florida (Collier County), in accordance with AAA Consumer Arbitration Rules.

9.2 Class Action Waiver

I WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION against the Released Parties.

9.3 Governing Law

This Agreement is governed by the laws of the State of Florida.

9.4 Opt-Out Right

I may opt out of the arbitration and class action waiver provisions by sending written notice to support@functionbonehealth.com within thirty (30) days of signing this Agreement.

10. Privacy and Data Acknowledgment

I acknowledge that I have read and agree to:

11. Communication Consent

I consent to receive communications from Function Bone Health via email, SMS, and phone, including:

Service confirmations and reminders
Screening results notifications
Educational content and wellness information
Promotional offers and updates

I may opt out of promotional communications at any time by contacting support@functionbonehealth.com or using the unsubscribe link in any email. Service-related communications necessary for active bookings may continue.

12. Entire Agreement and Incorporated Documents

This Client Service Agreement, together with the Terms of Service, Privacy Policy, Disclaimer, Refund Policy, HIPAA-Aligned Notice, Client Rights, Cookie Policy, and Do Not Sell My Information Policy, constitutes the entire agreement between me and BioX Unlimited LLC regarding my use of Function Bone Health services.

If any provision of this Agreement is found unenforceable, the remaining provisions remain in full force and effect.

13. Acknowledgment and Signature

By signing below (or by clicking "I Agree" when creating my account online), I acknowledge and confirm that:

I am at least 18 years of age (or 16 with parental consent below) and legally competent to enter into this Agreement
I have read and understand this entire Agreement
I have read and agree to all Legal Documents referenced herein
I voluntarily agree to all terms, including the release of liability, waiver of claims, indemnification, mandatory arbitration, and class action waiver
I understand that Function Bone Health provides educational screening services only, NOT medical care
I have had the opportunity to ask questions about this Agreement

Electronic Signature Notice
