These Terms of Service ("Terms") constitute a legally binding agreement between you ("Client," "you," or "your") and BioX Unlimited LLC, a Florida limited liability company, doing business as Function Bone Health and operating Strength Lab Plus wellness studios (collectively, "Company," "we," "us," or "our"). By accessing or using our website at functionbonehealth.com ("Website"), booking any services, creating an account, purchasing products, or otherwise engaging with our services, you acknowledge that you have read, understood, and agree to be bound by these Terms, together with our Privacy Policy, Disclaimer, HIPAA Notice, Client Rights, Cookie Policy, Refund Policy, and Do Not Sell My Information Policy (collectively, the "Legal Documents").
If you do not agree to these Terms, you must immediately cease all use of our Website and services.
THIS SECTION IS MATERIAL TO THIS AGREEMENT. PLEASE READ CAREFULLY.
Function Bone Health is a wellness education and screening center. We are NOT a healthcare provider, medical clinic, medical practice, hospital, diagnostic center, or any form of licensed medical facility. We do not hold ourselves out as providing medical services of any kind.
All services provided by Function Bone Health, including but not limited to REMS bone health assessments, body composition analyses, wellness consultations, educational plans, courses, webinars, articles, and any other content or service, are provided solely for educational and informational purposes. Our services are designed to support your general wellness awareness and to empower you with information that you may choose to share with your licensed healthcare professional.
Your use of our services, attendance at our facilities, communication with our staff, purchase of our products, or engagement with our content does NOT create any of the following relationships:
All individuals providing services at Function Bone Health serve in the capacity of wellness coaches, health educators, and screening technicians. They do not function as, and shall not be construed as, physicians, medical doctors, nurse practitioners, physician assistants, therapists, psychologists, dietitians, or any licensed medical professional acting within a clinical capacity. Any credentials held by our staff members are disclosed for informational transparency and do not indicate that medical services are being provided under the Function Bone Health brand.
Our REMS bone health assessments are screening measurements, not medical diagnoses. The results we provide are numerical measurements and data points generated by FDA-cleared screening technology. These results do not constitute a medical diagnosis, clinical assessment, or medical opinion. You should share all screening results with your licensed healthcare professional for clinical interpretation and medical decision-making.
Function Bone Health operates its REMS screening services under a Screen My Bones license. Screen My Bones is a separate entity and is not affiliated with, owned by, a subsidiary of, or a partner of BioX Unlimited LLC or Function Bone Health. The Screen My Bones license authorizes the use of specific screening protocols and does not extend to any other provider or entity.
You should always consult a qualified, licensed healthcare professional before making any health-related decisions. The information and screening results provided by Function Bone Health are not substitutes for professional medical advice, diagnosis, or treatment. Never disregard professional medical advice or delay seeking medical consultation because of information obtained through our services.
You must be at least eighteen (18) years of age to use our services, create an account, or make purchases. Individuals aged 16–17 may use our services only with verifiable written consent from a parent or legal guardian who has also agreed to these Terms. We do not knowingly provide services to individuals under the age of 16.
By using our services, you represent and warrant that you have the legal capacity to enter into this agreement and that you are not prohibited from doing so by any applicable law or regulation.
You agree to provide accurate, current, and complete information when creating an account, booking services, or otherwise interacting with us, and to promptly update such information as necessary.
Function Bone Health currently offers the following services, all of which are educational and informational in nature:
We reserve the right to modify, suspend, discontinue, or introduce new services at any time, with or without notice. The service available at the time of your booking will be honored for that specific booking.
Services are available at designated Function Bone Health and Strength Lab Plus locations. Availability may vary by location and is subject to scheduling, equipment availability, and staffing.
To access certain services, you may be required to create an account. You agree to provide truthful, accurate, and complete registration information and to maintain and promptly update such information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
Upon account creation, you will be required to execute a Client Service Agreement and Informed Consent form. This one-time agreement forms part of these Terms and must be completed before any services can be rendered.
You agree to immediately notify us at support@functionbonehealth.com if you become aware of any unauthorized use of your account or any other breach of security. We shall not be liable for any loss or damage arising from your failure to protect your account credentials.
All appointments must be booked through our Website, by phone, or at one of our locations. A security deposit is required at the time of booking and will be applied toward the total service cost.
Bookings are confirmed upon receipt of the security deposit and a confirmation communication (email or SMS). We reserve the right to decline or cancel any booking at our sole discretion.
Clients should arrive on time for scheduled appointments. Late arrivals may result in shortened service time or rescheduling, at our discretion. Any specific preparation instructions will be communicated at the time of booking.
All prices are listed in U.S. dollars (USD) and are subject to change without prior notice. The price in effect at the time of your booking will apply to that booking.
We accept major credit and debit cards, as well as HSA/FSA payments where eligible. Payment is processed through Stripe, our third-party payment processor. We do not store credit card information on our servers.
A security deposit is required for all bookings. Deposit amounts vary by service and package. Deposits are applied toward the total cost of services. Deposit terms are further detailed in our Refund Policy.
Full payment is due at or before the time of your appointment, unless otherwise agreed in writing.
Our services may be eligible for payment using Health Savings Account (HSA) or Flexible Spending Account (FSA) funds. It is your sole responsibility to verify eligibility with your plan administrator. We make no guarantee of HSA/FSA acceptance by your specific plan, and we are not responsible for any tax implications resulting from your use of HSA/FSA funds.
You are responsible for any applicable taxes, duties, or governmental charges associated with your purchases.
Cancellation, rescheduling, and refund terms are governed by our Refund Policy, which is incorporated herein by reference and available at functionbonehealth.com/legal/refund-policy.
The supplement products available through our store are provided for educational and informational purposes and for your convenience. Product descriptions, ingredient information, and any associated content are provided by manufacturers and/or compiled for educational reference.
These statements have not been evaluated by the Food and Drug Administration. Products sold through our supplement store are not intended to diagnose, treat, cure, or prevent any disease.
You should always consult your licensed healthcare provider before starting, stopping, or changing any supplement regimen. We are not responsible for any adverse reactions, interactions, or health outcomes resulting from the use of any supplement purchased through our store.
The availability of supplements in our store does not constitute a prescription, medical recommendation, or endorsement by any healthcare professional. Supplements are curated based on general wellness research and are not personalized medical recommendations.
All content, materials, text, images, graphics, logos, trademarks, trade names, software, data, reports, screening results formats, educational materials, course content, and any other intellectual property displayed on or provided through our Website and services ("Content") are the exclusive property of BioX Unlimited LLC or its licensors and are protected by U.S. and international copyright, trademark, patent, trade secret, and other intellectual property laws.
We grant you a limited, non-exclusive, non-transferable, revocable license to access and use our Website and Content solely for your personal, non-commercial use in connection with our services. This license does not include the right to reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any Content.
You may not, without our prior written consent: copy, reproduce, or distribute any Content; use any data mining, robots, or similar data gathering methods; use our trademarks, trade names, or logos; frame or mirror any portion of our Website; or reverse engineer any software or technology used in our services.
While you retain rights to your personal screening data and results, the format, presentation, educational materials, and analysis methodologies associated with your results remain our intellectual property.

Our Website and services may integrate with or contain links to third-party websites, services, or content, including but not limited to Stripe (payment processing), GoHighLevel (booking and CRM), Google Analytics (website analytics), and social media platforms. These third-party services are governed by their own terms and privacy policies, and we are not responsible for their content, practices, or policies.
The inclusion of any third-party link or integration does not imply endorsement, sponsorship, or recommendation by Function Bone Health.
The REMS (Radiofrequency Echographic Multi Spectrometry) technology used in our bone health assessments is manufactured by Echolight S.p.A. and is FDA-cleared under 510(k) K213854.
While REMS technology is FDA-cleared and uses validated screening methodologies, no screening technology is perfect. Results may be affected by various factors including, but not limited to, body composition, positioning, operator technique, and individual physiological variations. Results are screening measurements and are not guaranteed to be free from errors or inaccuracies.
REMS bone health assessments are not intended to replace DXA scans, X-rays, CT scans, MRI, or any other medical diagnostic imaging. Our assessments are complementary screening tools that provide educational information about your bone health.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ALL SERVICES, CONTENT, PRODUCTS, AND INFORMATION PROVIDED BY FUNCTION BONE HEALTH ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. We specifically disclaim all implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

This limitation applies regardless of the theory of liability, whether based on warranty, contract, tort (including negligence), strict liability, or any other legal theory, and whether or not the Protected Parties have been advised of the possibility of such damages.
Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability shall be limited to the maximum extent permitted by law.
You agree to indemnify, defend, and hold harmless all Protected Parties from and against any and all claims, demands, actions, causes of action, suits, proceedings, losses, damages, liabilities, costs, and expenses (including reasonable attorneys' fees and court costs) arising out of or relating to:

Any dispute, claim, or controversy arising out of or relating to these Terms, our services, or any Legal Document ("Dispute") shall be resolved exclusively through final and binding arbitration administered by the American Arbitration Association ("AAA") in accordance with its Consumer Arbitration Rules, rather than in a court of law. The arbitration shall be conducted in Naples, Florida (Collier County).
YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. You waive any right to participate in a class action lawsuit or class-wide arbitration against the Protected Parties.
The following are not subject to arbitration: (a) claims that may be brought in small claims court if they qualify; (b) actions to enforce intellectual property rights; and (c) requests for injunctive or equitable relief.
You may opt out of this arbitration provision by sending written notice to support@functionbonehealth.com within thirty (30) days of first accepting these Terms. The notice must include your full name, account email, mailing address, and a clear statement that you wish to opt out of the arbitration and class action waiver provisions.
These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles. To the extent that litigation is permitted, you consent to the exclusive jurisdiction and venue of the state and federal courts located in Collier County, Florida.
Your privacy is important to us. Our collection, use, disclosure, and protection of your personal information are governed by our Privacy Policy (functionbonehealth.com/legal/privacy), HIPAA Notice (functionbonehealth.com/legal/hipaa-notice), Cookie Policy (functionbonehealth.com/legal/cookies), and Do Not Sell My Information Policy (functionbonehealth.com/legal/do-not-sell), each of which is incorporated herein by reference.
By creating an account or providing your email address, you consent to receive electronic communications from us via email, including but not limited to appointment confirmations, service-related updates, screening results notifications, educational content, and promotional materials. You may opt out of promotional email communications at any time by following the unsubscribe instructions provided in each email or by contacting us at support@functionbonehealth.com. Service-related emails necessary for the fulfillment of your booked services may continue even after you opt out of promotional emails.
By providing your mobile phone number and opting in to receive text messages — whether through our Website booking form, account registration, in-person sign-up form, paper form, verbal confirmation, or by texting a keyword to our designated number — you expressly consent to receive recurring automated and non-automated SMS and MMS text messages from Function Bone Health (operated by BioX Unlimited LLC) at the mobile number you provided, including messages sent using an automatic telephone dialing system.
You may receive the following types of text messages:
Message frequency varies. You may receive up to 10 messages per month depending on your appointment schedule and communication preferences. Message and data rates may apply depending on your mobile carrier plan. We are not responsible for any fees charged by your carrier.
Consent to receive text messages is not a condition of purchase. You are not required to opt in to SMS communications to book or receive our services.
You may opt out of text messages at any time by:
After opting out, you will receive a single confirmation message. No further messages will be sent unless you re-opt in. Opting out of SMS does not affect other communication channels (email, phone calls).

SMS messaging is supported on all major U.S. carriers, including but not limited to AT&T, Verizon, T-Mobile, Sprint, and their affiliates. Carrier delivery is not guaranteed. We are not liable for delayed or undelivered messages.
We do not sell, rent, lease, or share your phone number or SMS opt-in data with third parties for their marketing purposes. Your phone number and consent information are shared only with our messaging service provider (currently GoHighLevel/LeadConnector via Twilio) solely for the purpose of delivering text messages on our behalf. By opting in to text messages, you agree to these Terms of Service (functionbonehealth.com/legal/terms) and our Privacy Policy (functionbonehealth.com/legal/privacy). These terms govern all SMS/MMS communications from Function Bone Health.
We shall not be liable for any failure or delay in performing our obligations under these Terms if such failure or delay results from circumstances beyond our reasonable control, including but not limited to: natural disasters, pandemics, epidemics, government actions or orders, wars, terrorism, civil unrest, strikes, labor disputes, power failures, internet outages, equipment failures, or acts of God.
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if modification is not possible, shall be severed from these Terms. The invalidity or unenforceability of any provision shall not affect the validity or enforceability of the remaining provisions.
These Terms, together with all other Legal Documents referenced herein and the Client Service Agreement, constitute the entire agreement between you and BioX Unlimited LLC regarding your use of our services and supersede all prior and contemporaneous agreements, proposals, representations, and understandings, whether written or oral, relating to the subject matter hereof.
No waiver of any term or condition of these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition. Our failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.
You may not assign or transfer these Terms or any rights or obligations hereunder without our prior written consent. We may assign these Terms and our rights and obligations without restriction and without notice to you.
We reserve the right to modify these Terms at any time. Material changes will be communicated by posting the revised Terms on our Website with an updated "Last Updated" date and, where practicable, by sending notice to the email address associated with your account. Your continued use of our services after the effective date of any modifications constitutes your acceptance of the modified Terms. If you do not agree to the modified Terms, you must discontinue use of our services and close your account.
All provisions of these Terms that by their nature should survive termination shall survive, including but not limited to: Intellectual Property, Disclaimer of Warranties, Limitation of Liability, Indemnification, Dispute Resolution, and any accrued obligations.
The section headings in these Terms are for convenience of reference only and shall not affect the interpretation of these Terms.
